AIM OF POLICY: Northumbria Police supports the principle of penalty notices for disorder with a view to providing an effective and alternative means of dealing with low level anti-social and nuisance behaviour which does not require a court hearing. To provide an effective deterrent, whilst reducing the amount of time police officers spend completing paperwork for court, leaving them free to deal with more serious categories of crime.
BENEFIT OF POLICY: To provide an alternative and effective deterrent in cases of low level anti-social and nuisance behaviour.
REASON FOR POLICY: Criminal Justice and Police Act 2001 (S1-11) issuing penalty notices for disorder.
Northumbria Police supports the principle of Penalty Notices for Disorder (PND), the aim of which is to provide:
An effective and alternative means of dealing with low level, anti-social and nuisance offending which does not require a court hearing.
A swift, simple and effective justice that carries a deterrent effect.
A reduction in the amount of time police officers spend completing paperwork and attending court whilst simultaneously reducing the burden on the courts.
An increase in the amount of time available for officers to spend on the street dealing with more serious crime.
Under the powers granted by the Criminal Justice and Police Act 2001 (s,1-11), police officers, police community support officers, detention officers and custody investigation officers are able to issue penalty notices for disorder.
PNDs will only be issued to persons aged 18 and over and will result in either a £60 or £90 fine. By paying the penalty, a PND allows the recipient the opportunity to discharge their liability to conviction for the offence the notice was issued.
A PND will not be used to tackle racially-motivated crime, domestic incidents, football related incidents or any cases whereby people or property are attacked.
