Provision of information held by Northumbria Police made under the Freedom of Information Act 2000 (the 'Act') 

Thank you for your e mail dated 29 September 2016 in which you made a request for access to certain information which may be held by Northumbria Police. 

As you may be aware the purpose of the Act is to allow a general right of access to information held at the time of a request, by a Public Authority (including the Police), subject to certain limitations and exemptions. 

You asked: 

Please could you tell me: 

For EACH calendar year from 2010 up until 2016

1.How many Employment Tribunal cases were brought against Northumbria Police by

a)  Staff

    i) Male

   ii) Female

b)  Officers

   i)  Male

   ii)  Female 

2.  In each of the above categories (again for each year from 2010 until 2016), how many of these cases resulted in a Tribunal Judgement which was 

a)  Won by the Claimant against Northumbria Police

b)  Won by the Respondent (ie Northumbria Police) against the Claimant

c) Neither respondent nor Claimant won on all points 

3.  In each of the cases identified above (again for each year from 2010 until 2016),

   i)  On how many occasions was an Appeal to the Employment Appeal Tribunal launched by the Claimant?

   ii) On how many occasions was an Appeal to the Employment Appeal Tribunal launched by the Respondent? 

4. On how many occasions (again for each year from 2010 until 2016), did Northumbria Police lodge a Cost Application against the Claimant?

  a)  And on how many of these occasions was the Claimant female? How many occasions was the Claimant male?

  b)  And on how many occasions was the Cost Application successful in awarding costs against the Claimant? 

With respect to Question 4 of my Freedom of Information Request, could you please clearly specify whether any Cost Application was made against an Individual person or whether it was made against a Union/Federation which was representing the individual.

Additionally, could you please specify when (in which year)  Northumbria Police last made a Cost Application against an individual (as opposed to a Union or other body)  following a Employment Tribunal - and whether that Cost Application was successful in recovering costs which Northumbria Police may have incurred during the Employment Tribunal. 

We have now had the opportunity to fully consider your request and I provide a response for your attention. 

Following receipt of your request, searches were conducted with the Legal Department of Northumbria Police. I can confirm that the information you have requested is held by Northumbria Police. 

I am able to disclose the located information to you as follows.

Due to the low numbers involved in this subject area, this information has been provided in such a way as to avoid exemptions being applied to the whole request. Particularly the exemption outlined in Section 40 of the Act would become fully applicable should there be a real risk of individuals being identifiable through the release of information in response to a Freedom of Information request. In this case, should the full detail be supplied, it is clear from the information held that the individuals involved would quite easily be identified if a complete response was to be released into the public domain. The information below is supplied in the spirit of the Act. Please note that this disclosure will be taken into consideration should any further requests be submitted on this subject.

In 2010 there were four Employment Tribunal (ET) claims made. Two were from male police officers. Two were from female police staff members.

In 2011 there were four ET claims made. One was from a female police officer. Two were from female staff members. One was from a male staff member.

In 2012 there were six ET claims made. Three were from female police officers. Two were from male police officers. One was from a male staff member.

In 2013 there were three ET claims. Three were from female police officers.

In 2014 there were three ET claims. One was from a male police officer. One was from a female police officer. One was from a female staff member

In 2015 there were three ET claims. One was from a female staff member. Two were from male staff members.

One claim commenced in 2011 from a male police staff member led to a judgment The claim was won by the Respondent.

One claim from 2012 commenced by a male police officer led to a judgment. The claim was won by the Claimant.

One claim in 2012 commenced by a female police officer led to a judgment. The claim was won by the Respondent.

One claim commenced in 2014 by a female police staff member led to a judgment. The claim was won by the Respondent

One claim commenced in 2015 by a female police staff member led to a judgment. The claim was won by the Claimant.

One claim commenced in 2011 by a male staff member led to an appeal to the Employment Appeal Tribunal (EAT) by the Claimant.

One claim commenced in 2012 by a female police officer led to an appeal to the EAT by the Claimant.

One claim commenced in 2012 by a male police officer led to an appeal to the EAT by the Respondent and a cross appeal by the Claimant.

One claim commenced in 2014 by a female police staff member led to an appeal to The EAT by the Claimant

On one occasion the Chief Constable made a costs application against the unsuccessful Claimant.

Due to the different methods of recording information across 43 forces, a specific response from one constabulary should not be seen as an indication of what information could be supplied (within cost) by another.  Systems used for recording these figures are not generic, nor are the procedures used locally in capturing the data.  For this reason responses between forces may differ, and should not be used for comparative purposes.
