Provision of information held by Northumbria Police made under the Freedom of Information Act 2000 (the 'Act')(FOIA)

Thank you for your email dated 1 February 2013 in which you made a request for access to certain information which may be held by Northumbria Police.

As you may be aware the purpose of the Act is to allow a general right of access to information held by a Public Authority (including the Police), subject to certain limitations and exemptions.

You asked: 

  1. How many speeding offences overall were committed in the force area in the years 2011, 2012 and so far in 2013. Please provide a breakdown of the number of offences for each year. 
      

  2. What was the fastest speed recorded in your force area in the years 2011, 2012 and so far in 2013. 
      

  3. Please can you name the road where the fastest speed was recorded in the years 2011, 2012 and so far in 2013. provide me with all such Appendix H forms held by your police force where the incident took place in the last financial year (11/12), the Taser was fired, and the intended subject was an animal.

In response:

We have now had the opportunity to fully consider your request and I provide a response for your attention.

Following receipt of your request, searches were conducted with the Fixed Penalty Unit of Northumbria Police.  I can confirm that the information you have requested is held by Northumbria Police.

I have today decided to disclose the located information in part to you as follows. Please note, the information provided for 2013, in questions 1,2 and 3, is taken from recorded data and is valid up to 3rd February 2013.

    2012 - 73,027 
    2013 - 2,500

  2. 2012 - 119mph 
    2013 - 103mph

  3. 2012 - A194 Whitemare Pool 
    2013 - A194 Gateshead

As the information you have requested at points 2 and 3 for 2011 is accessible by other means I have not provided you with a copy of the information and will rely on Section 21 of the Freedom of Information Act 2000.  You should therefore consider this a refusal for your request.

I have provided an explanation to this exemption below.

Section 21 (1) - Information accessible by other means

Information which is reasonably accessible to the applicant is exempt information.As the information you have requested is accessible by other means I have not provided you with a copy of the information and will rely on Section 21 of the Freedom of Information Act 2000.  You should therefore consider this a refusal for your request.

I have provided an explanation to this exemption below.

You have been provided with this information previously, your FOIA request 445/12 refers.

Due to the different methods of recording information across 43 forces, a specific response from one constabulary should not be seen as an indication of what information could be supplied (within cost) by another.  Systems used for recording these figures are not generic, nor are the procedures used locally in capturing the crime data.  For this reason responses between forces may differ, and should not be used for comparative purposes.

How to complain
